State Supplemental Privacy Notice

Effective date: February 1, 2024  


This U.S. State Supplemental Privacy Notice (“Notice”) supplements our Online Privacy Policy and describes how The Orvis Company (“Orvis,” “us,” “we,” or “our”) processes information relating to certain other states including, but not limited to, California, Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia (each a “Covered State”) consumers that visit Orvis.com (the “Site”). In the event of a conflict between any other policy, statement, or notice and this Notice, this Notice will prevail as to Covered State consumers. 


In this Notice, we may use the terms “Personal Information” and “Personal Data” interchangeably to refer to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable person. Personal Information does not include information that is publicly available. 


Unless otherwise noted, the disclosures that describe how and why we collect and use your Personal Information also describe how and why we collected and used your Personal Information within the past twelve (12) months. 


Collection and Use of Your Personal Information 


We may collect the following categories of Personal Information about consumers. Note that the Personal Information we collect about you may vary depending on the nature of your interactions with us, may not include all of the examples listed below, and some examples may fall into more than one category.  


  • Identifiers (such as name, email address, mailing address, unique personal identifier, telephone number, account login information, device identifier, and Internet Protocol address) 
  • How We Use the Information: (1) to process your purchases, online orders, returns, exchanges, and other transactions, (2) to communicate with you, including to respond to your inquiries and to obtain your feedback, (3) to send you marketing materials and advertisements, (4) to recognize you when you use our Site, (5) to allow you to participate in the features we offer on the Site, (6) to show you relevant ads while you browse the Internet or use social media, (7) to allow you to participate in promotions, sweepstakes, and contests, (8) to audit, research and analyze your use of our Site, (9) to maintain and improve the Site, (10) to detect and prevent fraud, and (11) for any other internal business purposes 
  • Sources of Personal Information: (1) directly from you, (2) automatically when you use our Site, and (3) from service providers/processors that help us to run our business 
  • Categories of Recipients of Personal Information: Service providers/processors  
  • Why We Disclose Personal Information: so that our service providers/processors can assist us in maintaining our relationship with you and communicating with you, including providing you with the products or services you requested and for customer service purposes 


  • Customer Records (such as name, email address, mailing address, telephone number, credit/debit card number). This category includes Personal Information described in Cal. Civ. Code § 1798.80(e). 
  • How We Use the Information: (1) to process your purchases, online orders, returns, exchanges, and other transactions, and (2) to communicate with you, including to respond to your inquiries  
  • Sources of Personal Information: (1) directly from you, and (2) from service providers/processors that help us to run our business 
  • Categories of Recipients of Personal Information: Service providers/processors  
  • Why We Disclose Personal Information: so that our service providers/processors can assist us in maintaining our relationship with you and communicating with you, including providing you with the products or services you requested and for customer service purposes 


  • Characteristics of Protected Classifications (such as gender, age, and marital status). This category includes characteristics that are protected under California or federal law. 
  • How We Use the Information: (1) to personalize our content to you, and (2) to market and advertise our products to you 
  • Sources of Personal Information: from service providers/processors that help us to run our business 
  • Categories of Recipients of Personal Information: none  
  • Why We Disclose Personal Information: N/A  


  • Commercial Information (such as records of products purchased or considered, information about returns or recalls, and products on your wish list) 
  • How We Use the Information: (1) to process your purchases, online orders, returns, exchanges, and other transactions, (2) to allow you to participate in the features we offer on the Site (including posting product reviews), (3) to send you marketing materials and advertisements, (4) to show you relevant ads while you browse the Internet or use social media, and (5) to detect and prevent fraud 
  • Sources of Personal Information: (1) your purchases/purchase history, and (2) your shopping experience with us on the Site 
  • Categories of Recipients of Personal Information: Service providers/processors  
  • Why We Disclose Personal Information: (1) to process your purchases, online orders, returns, exchanges, and other transactions, (2) to communicate with you, including to respond to your inquiries, and (3) to market or advertise to you 


  • Internet or Other Electronic Network Activity Information (such as browsing and search history on our Site and information about how you interact with our Site) 
  • How We Use the Information: (1) to allow you to participate in the features we offer on the Site, (2) to facilitate, manage, personalize, and improve your Site experience, (3) to provide you with recommendations, (4) to show you relevant ads while you browse the Internet or use social media, (5) to audit, research and analyze your use of our Site, (6) to maintain and improve the Site, (7) to detect and prevent fraud, and (8) for any other internal business purposes 
  • Sources of Personal Information: (1) automatically when you use our Site, and (2) from service providers/processors that help us to run our business

  • Why We Disclose Personal Information: (1) for security purposes, and (2) to improve our Site and services 


  • Sensory Data (such as audio recordings of customer calls and CCTV) 
  • How We Use the Information: (1) to provide you with customer service, and (2) for security purposes  
  • Sources of Personal Information: (1) directly from you, (2) automatically when you visit our stores, and (3) from service providers/processors that help us to run our business 
  • Categories of Recipients of Personal Information: Service providers/processors  
  • Why We Disclose Personal Information: (1) to provide you with customer service and (2) for security purposes 


  • Inferences (such as information about your preferences and household characteristics and your buying behaviors or tendencies) 
  • How We Use the Information: (1) to provide you with appropriate recommendations, (2) to improve the Site, and our products, marketing and advertising, (3) to help you find relevant products more quickly, and (4) to provide you with a better Site experience  
  • Sources of Personal Information: (1) from service providers/processors that help us to run our business, and (2) automatically when you use our Site 
  • Categories of Recipients of Personal Information: none 
  • Why We Disclose Personal Information: N/A  


In addition to the uses and disclosures of Personal Information described above, we may use and disclose any Personal Information as reasonably necessary to comply with law and legal requirements, cooperate with and respond to law enforcement requests, or as otherwise required by applicable law, court order, or governmental regulations. We also use Personal Information we collect as necessary to maintain appropriate records for internal administrative purposes, to protect our rights and interests or those of others, to resolve any disputes, to enforce our policies, or to prevent harm.  


Any Personal Information we collect may be provided to our professional advisors, including accountants, auditors, consultants, and lawyers, when reasonably necessary for our professional advisors to perform services for us and give us appropriate advice. Any and all Personal Information we collect may be given to another company in the event of a transaction such as a sale, merger, or other acquisition of some or all of our assets or business, or as part of the negotiation or evaluation of such transaction. 


How Long We Keep Your Personal Information

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or as otherwise authorized or permitted by law. This generally means holding the information for as long as one of the following apply: 


  • The Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information; 
  • The Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected; 
  • The Personal Information is reasonably required to protect or defend our rights or property; or 
  • We are otherwise required or permitted to keep your information by applicable laws or regulations.

Additional Disclosures of Personal Information  

Although we do not sell Personal Information in exchange for money, some of the ways in which we disclose Personal Information for advertising may be considered “sales” or “sharing” under some state privacy laws.  


We have sold and/or shared the following categories of Personal Information to outside parties, including marketing and advertising companies, for the purpose of providing analytics and targeted or cross-context behavioral advertising: 


  • Identifiers 
  • Customer Records 
  • Commercial Information 
  • Internet or Other Electronic Network Activity Information  


We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age.  


California Privacy Rights 

A. Submitting Requests Relating to Your Personal Information 

If you are a resident of California, you have the right to submit certain requests relating to your Personal Information as described below. You or someone you authorize, can submit privacy rights requests through our webform or by calling us at 1-833-390-1459.  


Please note that, if you submit privacy rights requests, we may ask you for specific information to help us confirm your identity prior to processing your request. Please follow any instructions provided and promptly respond to any follow-up inquiries so that we may confirm your identity and respond to your request. If you ask that we give you specific pieces of personal information or that we delete or correct certain types of personal information, we may apply heightened verification standards, which require additional proof of your identity. 


Only you, or someone you authorize to act for you, may make a request related to your personal information. If you designate an authorized agent to make a request for you, you may still need to verify your identity directly with us before your request can be processed. 


If we decline to fulfill your privacy rights request, we will tell you why, unless we are not legally permitted to do so. 


Right to Know. You have the right to request the following details about the Personal Information we have collected about you:  


(1) The categories of Personal Information we have collected about you, including  


  • The categories of sources from which the Personal Information was collected 
  • Our business or commercial purposes for collecting Personal Information 
  • The categories of recipients to which we disclose Personal Information 
  • The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information 


(2) The specific pieces of Personal Information we have collected about you 


Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions.  


Right to Correct Personal Information. You can review and change most personal information in your Orvis account at any time. Simply sign into your account using your email and password, and you will be able to update your personal information. You can also ask us to update your personal information by sending us an email at customerservice@orvis.com or calling us at 1-833-390-1459.  


Right to Opt Out of and Sharing. You have the right to opt out of the sale and/or sharing of your Personal Information. To opt out of the sale or sharing of Personal Information through tracking technologies such as cookies and pixels, click the “Do Not Sell or Share My Personal Information” link in the footer of the Site.  


Right to Non-Discrimination for the Exercise of Your Privacy Rights. We will not discriminate against you if you choose to exercise any of your privacy rights. 


B. California’s Shine the Light Law 

California customers may ask Orvis to provide them with (1) a list of certain categories of Personal Information that we have disclosed to other parties for their direct marketing purposes during the preceding calendar year, and (2) the identity of those other parties. California customers may make one such request per calendar year. 


To make a Shine the Light request, you may contact Orvis by email at customerservice@orvis.com. In your request, please state that you are a California customer and provide a current California mailing address for our response.  


Please note that your California’s Shine the Light law rights are distinct from your rights under other California privacy laws and must be exercised separately. 


Privacy Rights for Consumers in Other Covered States 

If you are a consumer who is a resident of a Covered State other than California, you may have the right to submit certain requests relating to your Personal Data as described below. You or someone you authorize, can submit privacy rights requests through our webform or by calling us at 1-833-390-1459.  


Please note that, if you submit privacy rights requests, we may ask you for specific information to help us confirm your identity prior to processing your request. Please follow any instructions provided and promptly respond to any follow-up inquiries so that we may confirm your identity and respond to your request. If you ask for access to your Personal Data or that we delete or correct certain types of Personal Data, we may apply heightened authentication standards, which require additional proof of your identity. 


You may designate an authorized agent to make certain requests on your behalf, but you may still need to authenticate your identity directly with us before your request can be processed. 


If we decline to fulfill your privacy rights request, we will tell you why, unless we are not legally permitted to do so. 


Right to Access and Data Portability. You have the right to confirm whether we are processing your Personal Data, to access your Personal Data, and to obtain a copy of Personal Data. You may also request that we send the copy of the Personal Data you provided to us in a portable format. 


Right to Correct. You may have the right to request that we correct inaccuracies in your Personal Data, taking into account the nature of the Personal Data and our purposes for processing it. 


Right to Delete. You have the right to request that we delete your Personal Data, subject to certain exceptions. 


Right to Opt Out. You have the right to opt out of the following uses of your Personal Data: (1) targeted advertising; (2) the sale of Personal Data; and (3) profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell Personal Data in exchange for money, or engage in practices that qualify as “profiling” which produces legal or similar significant effects under applicable state privacy laws. To opt out of targeted advertising and/or non-monetary “sales” of Personal Data, please click the “Do Not Sell or Share My Personal Information” link in the footer of the Site. 


Right to Appeal. Sometimes we are unable to process requests relating to your Personal Data, in which case, your request will be denied. If you believe we denied your privacy rights request in error, you may appeal for reconsideration of your request using our webform or toll-free phone number. 


Please note that if you make a privacy rights request, we will retain the Personal Data submitted in connection with your request for recordkeeping purposes.
