This U.S. State Supplemental Privacy Notice (“Notice”) supplements our Online Privacy Policy and describes how The Orvis Company (“Orvis,” “us,” “we,” or “our”) processes personal information relating to Orvis.com (“Site”) visitors who reside in certain other states including, but not limited to, California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia (each a “Covered State”). In the event of a conflict between any other policy, statement, or notice and this Notice, this Notice will prevail as to Covered State consumers. In this Notice, we may use the terms “Personal Information” and “Personal Data” interchangeably to refer to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable person. Personal Information does not include information that is publicly available.
Unless otherwise noted, the disclosures in this State Supplemental Privacy Notice that describe how and why we collect and use your Personal Information also describe how and why we collected and used your Personal Information within the twelve (12) months preceding the Effective Date listed above. If we make changes to this Notice, we will update the Effective Date. To the extent we intend to make changes to our data processing activities that would require your consent, we will obtain such consent in compliance with applicable law.
We may collect the following categories of Personal Information about consumers. Note that the Personal Information we collect about you may vary depending on the nature of your interactions with us, may not include all of the examples listed below, and some examples may fall into more than one category.

In some states and for some types of requests, you may designate an authorized agent to make a request on your behalf; however, for certain requests you will still need to verify your identity directly with us before your request can be processed. Please note that, if you submit privacy rights requests, we may ask you for specific information to help us confirm your identity prior to processing your request. Please follow any instructions provided and promptly respond to any follow-up inquiries so that we may verify your identity and respond to your request. If you make a request to access, delete, or correct your Personal Information, we may apply heightened authentication standards, which require additional proof of your identity.
You may designate an authorized agent to make certain requests on your behalf, but you may still need to authenticate your identity directly with us before your request can be processed.
If we decline to fulfill your privacy rights request, we will tell you why, unless we are not legally permitted to do so. We will not discriminate against you if you choose to exercise any of your privacy rights.

Right to Access and Data Portability. You may have the right to confirm whether we are processing your Personal Information, to access your Personal Information, and to obtain a copy of Personal Information. Right to Obtain Information About Third Parties. If you are a Minnesota, Oregon, or Rhode Island consumer, you may request a list of third parties with whom we have disclosed Personal Information. If you are a Maryland or a Delaware consumer you may also request to know the categories of third parties with whom we have disclosed Personal Information.
Right to Correct. You may have the right to request that we correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and our purposes for processing it. You can also review and change most Personal Information in your Orvis account at any time. Simply sign into your account using your email and password, and you will be able to update your Personal Information. You can also ask us to update your Personal Information by sending us an email at customerservice@orvis.com or calling us at 1-833-390-1459.
Right to Delete. You have the right to request that we delete your Personal Information, subject to certain exceptions.
Right to Opt Out. You may have the right to withdraw your consent and opt out of the following uses of your Personal Information: (1) targeted advertising; (2) the sale of Personal Information; and (3) profiling in furtherance of decisions that produce legal or similarly significant effects. We do not engage in practices that qualify as “profiling” which produces legal or similar significant effects under applicable state privacy laws. To opt out of targeted advertising and/or non-monetary “sales” of Personal Information via tracking technologies, please click the “Do Not Sell or Share My Personal Information” link in the footer of the Site.
Although the Site does not respond to “do not track” signals, you may opt out of targeted advertising and non-monetary sales of Personal Information on the Site by using an opt-out preference signal (like Global Privacy Control (GPC)) on a browser that supports GPC. If you turn on GPC through your browser, you will be opted out of sales and sharing in the context of cookies and tracking technologies on the Site that you visit using that browser. Right to Appeal. Sometimes we are unable to process requests relating to your Personal Information, in which case, your request will be denied. If you believe we denied your privacy rights request in error, you may appeal for reconsideration of your request using our webform or toll-free phone number.
Please note that if you make a privacy rights request, we will retain the Personal Information submitted in connection with your request for recordkeeping purposes.
California’s Shine the Light Law. California customers may ask Orvis to provide them with (1) a list of certain categories of Personal Information that we have disclosed to other parties for their direct marketing purposes during the preceding calendar year, and (2) the identity of those other parties. California customers may make one such request per calendar year.
